The courts nullify the first fine for the Gag Law in Cantabria – The Farad

This Friday, December 23, The Court no. 2 of the Contentious-Administrative of Santander has cancelled the first ticket that was filed in Cantabria applying the Gag Law, as it has been able to know THE FARAD.

Oscar Lard, activist and former spokesman of the PAH, led to the courts the fine that had brought the Delegation of Government after the occupation of one of the offices of Liberbank in Santander, which took place last 31 July in Santander.

According to the PAH Santander in a press release, the judge has estimated that it has "violated the presumption of innocence" of Butter in the fine lodged by the Delegation of the Government, "at not having had the tests requested by him in his pleadings, or other that could have demonstrated the innocence of the accused".

The sentence is final and cannot be appealed in front of her.

The fine came to Butter the 25th of August, where it accused Butter refuse to identify themselves when so requested the police officers who came to evict the members of the PAH that had come to 'occupy' the office of the calle Burgos, and require to negotiate some cases.

The complaint, therefore, was not by the occupation itself, a fact is constituted as a misdemeanor in the called Gag Law. Was the alleged refusal to be identified, which is classified as a serious offence, is fined with between 600 and 30,000 euros. To Butter had collected a total of 721 euros, the Administration must give back after winning the judgment.
