Lower penalty to the chileans who attacked basilica – The Universe

The Spanish Supreme Court reduced this Friday from twelve to four and a half years of prison the penalty imposed on two chileans of ideology anarchist by exploding a bomb in the basilica del Pilar of Zaragoza (north-east), said the court.

In march, the National court had pleaded guilty to Monica Andrea Caballero Sepulveda, 27, and Francisco Javier Solar Dominguez, 36, of two offences of injury and damage by terrorists for this attack that happened in 2013 and injured a woman.

however, the Supreme Court, considering an appeal by the defendant, understand that you should only receive a sentence of imprisonment for one of the offences thus committed a single tortious action, that, yes, it had several effects.

Solar argued that his intent was to detonate an explosive home for attacking a symbol within the church, but without causing injury.

The Supreme Court accepted this interpretation, appreciating the intent of committing a single action criminal, but given that the crime of injury by terrorists is the more severe of the two, condemned him for this four and a half years in prison.

In its ruling, the judges also reduced the compensation payable to the basilica of 182.600 to 143.317,8 euros because the trial was not proved the historical and cultural value of the damage. (I)
