Catalonia took the first step to reverse the summary judgments of Franco – Telam

The Catalan Parliament gave on Wednesday the green light to the passage of a law that aims to nullify the sentences of the summary court martial of the franco dictatorship, a step that amounts to an act of rupture with the impunity of the Spanish legal system in force.

The new standard Catalan declared “null and void and without any legal effect” all of the summary court martial for political causes in Catalonia between 1938 and 1975.

The death sentences of the anarchist Salvador Puig Antich and Joan Peiró, former president of Catalan Luis Companys, or leader, Manuel Carrasco i Formiguera, will be cancelled and the department of Justice in the Catalan government will be in charge of issuing the respective certificates to the families of these victims and referents of the fight franco.

In this way, the so-called “Law of Legal Redress for the Victims of the Franco regime”, aims to recognize people who fought for freedom against fascism.

The initiative was driven by the coalition indepedentista Junts pel Yes, the anti-capitalists of the CUP and Catalonia If that is Pot, the allies we Can. Despite the fact that neither Citizens, nor the socialists nor the Popular Party (PP) opposed head-on, warned that the law could be knocked down by the Spanish Constitutional Court, due to that the Catalan parliament has no competence in this matter.

“Were unfair trials and illegal. We have to overcome this democratic deficit and to provide reparation to the victims,” added the mp for independence, who expects the High court did not scarcely of this law because “you can’t legitimize the justice franco”.
