The evidence of age of foreign minors is practiced “systematically” – The Farad

The group Safe Passage, support to refugees and migrants, reported that the tests to determine the age of unaccompanied foreign minors is doing it "consistently" even though they have documentation on their age, legally, prevail.

So what have claimed to THE FARAD OF THE MORNING in ARC FM from this group, who attended Monday’s parliamentary intervention on the case of Samuel, the vice-president Eva Díaz Tezanos, whose macroconsejería depend on the Social Services in Cantabria.

An intervention that these activists has caused them to "disappointment," according influenced Patricia Manrique, who remembered that in the Cantabria region there are three cases more than that of Samuel, the youngest cameroonian subjected to tests of age –which precipitated his expulsion order— ordered from the Government to the office of the Prosecutor despite the fact that he had a birth certificate and passport, recognized by rulings and international agreements as sufficient.

Manrique lamented the approach "legalistic and bureaucratic", stressing that what he is doing "is not to apply the law," but rather "an interpretation very concrete", without giving any value to the documentation of minors despite the fact that "no one has doubted", as they have been admitted to Safe Passage from the Institute of Cantabria Social Services.

it Also emphasized that it is not the Prosecutor who is ultimately responsible to ensure for the minors, but to the social services of the governments, which must "protect them".

And afeaba references to the humanitarianism of the Government, which made the vice president, underscoring the fact that Samuel "left him without papers" and, therefore, "without rights", thus calling into question the humanitarianism.

For Safe Passage, officials at the ICASS, are applying the law in the least favorable for the children.

What Safe Passage request is that you finish with a review of the patterns of action and the establishment of a protocol of action that will put you ahead of the best interests of the child, since "how to apply the law can make a substantial difference that affects the lives of these children."

In his speech, the vice president was referring to the offer made to the counsel of Samuel to consider Samuel as a of age and to provide basic means of life, but without modification of its legal status.

This was rejected by Eugenia Gómez De Diego, to understand that "Samuel did not can have no future if you are denied your reality of a minor, the guardianship and, with it, the possibility of access to a legal residence permit in Spain.

This permission, when you have all of the right, would allow him to amortize his training and the skills acquired in this time with a stay in a regular that does not condemn you to isolation.

In summary, "Díaz Tezanos not challenged, with the data offered, that the ICASS, instead of assuming the child’s guardianship, has reactivated the de facto -not de jure, since it is not competent to do so directly, as you well pointed out – the expulsion of Samuel, nor explained why the ICASS dismisses the valid documents provided by the MENA and choose to let them pass the tests of determination of the age that even the UN itself has disqualified".

So for the group citizens for Safe Passage, the parliamentary process has been "disappointing".

"we Fear that we are doing practices, such as deprivation of legal aid to the determination of proof of age, the delay, if not refusal, to assume the guardianship, the obligation of documenting the minor -and not merely stored, the disclaimer of liability in the Prosecutor’s office… that, in fact, denying the rights of these unaccompanied minors in Cantabria, which are not taken into account as subject of rights. We ask that you review the protocols or established internally those measures that are necessary -to the office of the Prosecutor, the politicians, officials etc – that ensure the rights of unaccompanied minors in Cantabria, and hopefully in Spain, really", they assert.
