The reason for this letter is to raise awareness of the situation that is living in the province of Rio Negro in the field of rights of children, girls and adolescents. That, following the project of inquiry that led him forward, framed in the Practice of Social Service in the Community, of the Bachelor’s degree in Social Service, career course in the Faculty of Rights and Social Sciences of the University of Comahue.
To inquire about the treatment of the rights of children and adolescents specifically in the city of Rock, I encounter a judgment of the Superior Court of Justice of Rio Negro, which is applied to the entire province. The same, would allow for the detention by police of children and adolescents, which in his opinion are in a situation of abandonment or vulnerability; without having been through any unlawful.
it Is from this that it seems to me important to reflect that these are not cases in which the police acts to prevent a crime by respecting the laws in force; but is that without any evidence, without court order, without the intervention of a judge, are criminalised, persecuted children, and adolescents. Therefore the detention is given by the single fact of being under age, and in a discriminatory and stigmatizing, rather than protective.
I Believe that the ruling confuses dangerously prevention and safety, with comprehensive protection of the child or adolescent; that the arrests are intended to be justified in the name of protection and in reality only hidden prejudices that exist, and encourage from different areas against groups of humble and vulnerable, against those who have a certain skin color, certain clothing, or in the area that were circulating at that time.
I should emphasize that the situation that enabled the failure, is aggravated because the provincial police do not have specialized training in childhood, without having to clarify, that the police station is not appropriate place where they can remain children, girls and adolescents, because they should only be housed in specialized venues, emphasizing that it should be the agency proteccional the manager to address the situations of abandonment or vulnerability for the country and not the police.
In this sense, he remarked that this sentence does not respect the principle of progressive taxation, which governs in the field of Human Rights; it does not respect the Convention on the Rights of the Child; does not respect the International Covenant on Civil and Political Rights, nor the judgments and the Advisory Opinion 17 of the inter-American Court of Human rights that are mandatory. Also neither respects the National Law of Integral Protection of Children and Adolescents 26.061, or its analogous provincial, law 4.109.
this is Not to hand, that both the Local Council of Childhood and Adolescence (Conya) of the city of General Roca, as councils of other cities of the province, the Observatory of Human Rights of the province, the city Council of Rock and the Faculty of Law and Social Science, emerged in rejection of the decision of the Superior Court of Justice of the Province of Rio Negro; as well as accompanying the appeal of the judgment and the filing of appeals in the Supreme Court of the Nation and the bodies of DD.HH in order to reverse this failure. In turn, it can be said that there is evidence of a remarkable lack of implication, or omission of positioning in front of the failure, on the part of provincial agencies that are directly linked to the alleged defense and protection of the rights of childhood and adolescence.
In this way, I consider that the failure would mean a regression in relation to the work that has been carried out by the organizations in the field of Human Rights in the province, for which I insist in the need that the community know about the fault that violates the rights of boys, girls and adolescents, to discuss and consider actions that will not generate a backward step on rights, but a step forward. In addition, it is important to think about what we want for the childhood and adolescence, and what perspective they have of the subject that outline the policies of our province.
