ABC of Spain 2 / The Constitutional Court has decided to lift the temporary suspension of the Catalan law in which the use of the technique of hydraulic fracturing, or fracking regulated in the search for hydrocarbons in the autonomous community.

This regulation is included in Article 167.1 of the law on fiscal, administrative, financial measures and public sector in Catalonia, which was suspended by the Constitutional Court in November following the challenge to the central government.

In particular, the standard proposes a ban on hydraulic fracturing “when it can have negative effects on geological, environmental, scenic or socioeconomic characteristics of the area, or in relation to other areas competence of the Government “. Now, according poblica the Official Gazette (BOE), the Court lifted the suspension, which could maintain for a period of five months.

The government approved in December a bill to amend the hydrocarbons law, where tax incentives for municipalities and communities hydrocarbon deposits in their territories are collected, including those extracted by fracking.

Cantabria and La Rioja The Constitutional already ruled on the merits in the regulations of Cantabria and La Rioja prohibiting the use of fracking in their territories and in both cases the declared unconstitutional on the grounds that management of the energy sector and subsector gas company is an exclusive competence of the state.

In addition to Catalonia, La Rioja and Cantabria, communities of Navarra and Andalusia have legislated against this practice, which consists in breaking through water mixed with sand and other elements rocky areas where subsurface hydrocarbon reserves are hosted pressure.

In Spain there are about fifty permissions granted to conduct surveys in Asturias, Cantabria , Castilla y León, the Basque Country, Aragon, Catalonia and Castilla La Mancha; and many others requested in those regions over Valencia and Navarra
