Sabater added that the decision of the city Council was not a “question of identity”, in a context of tense relations between the Spanish institutions and Catalan demands for independence from the Spanish State of the part of the catalans.
The judge has also considered that this decision of the city Council puts in jeopardy the right of their workers to not manifest itself ideologically, and, therefore, violates their freedom.
“There is a clear risk that the administrative action contested, if indirectly, compel public employees to significarse, in one sense or another, in relation with the festivity of 12 October,” said the car.
Sabater became mayor of Badalona in the last local elections with the votes of Guanyem Badalona in Common, PSC, ERC, ICV-EUiA and CDC, which enabled it to oust the popular Xavier García Albiol in the City despite their victory in municipal elections.
