The Belgian Constitutional Court today recognized the right of Delphine Boël, alleged illegitimate daughter of King Albert II, to proceed with the process of demonstrating their kinship with the former head of state, father of the present King Philip.
The Court ruled that the right of a person to know the identity of his biological father premium on the legal certainty of existing family ties, Belga news agency reported.
The judges have responded well to the questions raised in November 2014 by the court of first instance in Brussels.
The judgment of the Court concluded that it is contrary to the Belgian Constitution the obligation under national civil law, to submit claims about affiliations before the 22 years of the plaintiff or at most the same year that the person knew who his real father.
This conclusion allows Boël, now 48, to go ahead with the procedure initiated in September 2014, when he began the trial in order to prove your relationship to Alberto II, who abdicated in favor of his son Felipe in July 2013.
Previously, his alleged illegitimate daughter undertook a process to show that Jacques Boël, his legal father was not really his biological father.
Boël explained that engaged the whole process because they feel discriminated against as alleged daughter of Alberto II.
The lawyer affected, Marc Uyttendaele, said today that Boël “continue the process” and that her client notes that “the search for paternity is not subject to any other conditions apart proof of the existence of a biological link between a daughter and her father, “said Belga.
On the other hand, Alain Berenboom lawyer Albert II, who holds the title of king though it is no longer the head of the Belgian-State, said that the Court of First Instance in Brussels you must now decide whether the request for Beoël, which is admissible, is well founded.
