The double standard – Portafolio.co

Arnaldo Otegi is a political controversial Spanish Basque Country which has just been disqualified by the electoral authorities to be a candidate for Lehendakari, or President the Basque Country. The decision follows that Otegi was sentenced to prison in September 2011 for being a board member of the terrorist group ETA, in the famous case Bateragune.

Last March, Otegi was released from prison and tried to recover their role in politics, but his condition prevented him convicted. According to the prosecution case where the sentence originated, Otegi is ineligible because he has been convicted of the crime of terrorism, according to the Spanish electoral law and the Basque Country, they are ineligible who have been convicted of rebellion, terrorism or crimes public administration or state institutions.

Why Spain has such legislation? Simply because the exercise of full democratic rights and the ability to represent the company can not be occupied by people whose sentences dishonor institutions.

The funny thing is that the same standard has been collected by Colombian law long ago, and in fact, our Constitution, in Article 179, prohibits persons convicted of offenses, except politicians and related, may be members of Congress. The same pattern applies for other elected offices.

As if that were not enough, in the Legislative Act for Peace, 2013, with the proposal of then-Senator Juan Lozano, he was banned those responsible for crimes against humanity could reach elected office.

While in Spain the law applies in Colombia is relativized, and without any fuss, Article 36 of the Agreement of Justice between the government and the FARC is said clearly that “the imposition of any penalty in the SIVJRNR not disabled for
