The Criminal Chamber of the Supreme Court declared its lack of competence to deal with the complaint that filed last year by the political party Soberanir against former Prime Minister Jose Luis Rodriguez Zapatero for bribery allegedly committed by granting pardon Alfredo Saenz, former CEO of Banco Santander. The reason is that at the time decreed file this issue last October, the former president had already ceased to be graduated to not be a member of the State Council.
In that order, dated October 2, 2015, the high court agreed to file the complaint unless the allegations constitute a crime. After checking later officially, through the website of the State Council, Zapatero currently not part of that, the Chamber concludes that the change of status of the defendant during the pendency prevents you hear the complaint.
For this reason, estimates the application for reconsideration submitted by the political party sovereignty against the now canceled auto and agrees that, if any, of the complaint before the competent court for information.
The resolution now canceled, the Supreme declared for the second time that the pardon granted by the socialist government that was CEO of Banco Santander, Alfredo Saenz, did not constitute a crime and therefore dismissed the complaint filed by the political party Sovereignty of Reason (Soberanir) against president Jose Luis Rodriguez Zapatero for bribery.
In 2012 had already filed a similar complaint to the same party, powered by the Murcia lawyer José Luis Mazon, filed on the same facts, which then called constitute a trespass.
The decision of the Executive of the PSOE, adopted when he was already in office, exempted Saenz sentenced to three months’ imprisonment and disqualification for false report, according to the order made on 28 March.
Soberanir had denounced the arbitrariness of the measure of grace granted by a government that was in office. He suggested in its complaint that Rodríguez Zapatero wanted to “compensate the bank Santander by refinancing some debt and the cancellation of 12 million euros” to the PSOE, while alluding to the “mortgage granted by this entity Rodriguez Zapatero to purchase a villa”.
In this respect the Supreme noted in its order for removal from the direct link between the loan to the political party of the defendant and clemency, or between the alleged debt forgiveness and the prerogative of grace, “it does not seem feasible as a matter of dates”.
It also indicates that the complainant did not provide any data indicative that the former Prime Minister will have condoned a personal loan. However, now provides an opportunity for Soberanir to resubmit the complaint before an ordinary court
