MADRID The Spanish Justice investigate the leadership of ETA for crimes against humanity in connection with the murders committed by the armed group from October 1, 2004, when this type of offense entered into force in Spain. The judge of the Audiencia Nacional, Juan Pablo González , said “the crimes” of ETA committed “as part of a systematic attack against part of the civilian population, made up of groups that are persecuted for political and ideological reasons. ” He said his “elimination or expulsion through coercion or terror are considered strategically necessary for the organization to achieve its political objectives,” the independence of the Basque country from the rest of Spain and the annexation of Navarre. The investigation opened only applies to acts committed since October 1, 2004 as the Spanish penal code did not exist until then “no rule to establish a penalty” for crimes against humanity.
