The Spanish Constitutional Court declared this illegal Thursday symbolic vote on independence held on November 9 in the region of Catalonia, whose organization triggered a judicial inquiry into the Catalan President Artur Mas.
Its executive promoted this vote without legal value, even though the Constitutional Court claimed his interim at the request of Spanish conservative government suspension. 2.3 million people participated and 1.9 voted for independence on a total census of 6.3 million people.
After studying the merits of the case, the high court declared that query unconstitutional because “an autonomous community can not convene or perform actions (…) to sponsor the call for a referendum, although no referendary, overflowing the scope of the powers”.
This statement may affect the judicial process initiated by the prosecution against Mas and two members of his government, accusing them of disobedience, prevarication, embezzlement of public funds and abuse of power by boosting the vote.
